Overview

By purchasing from XMS Heavy Industries you agree to these terms. Most of our work is supplied to businesses, laboratories, research institutes and trade buyers. Where a term applies only to consumers, this is stated.

Made-to-order work

Vacuum chamber assemblies configured through our chamber builder, custom flange converters, and all quoted fabrication are made to the buyer's specification. Once fabrication has begun these orders cannot be cancelled, modified or returned except where the goods are faulty or not as described. Full terms are in our refund policy.

Catalogue and pre-order parts

Production parts are built to order in batches. Payment in full at checkout reserves your slot in the production queue. Lead times are estimates, not guarantees; we will keep you informed as your batch progresses. Consumers in the EU and UK retain a 14-day right of withdrawal on these parts, as set out in our refund policy.

Order verification

We verify orders before fabrication begins. This includes confirming the specification is buildable and that we are able to supply to the destination. Where we cannot proceed, we cancel the order and refund it in full before any work starts.

Fitment

It is the responsibility of the buyer to confirm fitment for their vehicle, drivetrain or vacuum system before ordering. If you are unsure, contact us through the quote form and we will confirm before you order. For vacuum work, confirm flange standards and sizes against your existing hardware — the chamber builder checks that parts mate with each other, not that they mate with equipment we cannot see.

Intended use

Performance and off-road parts are intended for off-road and motorsport use. Vacuum components are intended for laboratory, research and industrial vacuum service within their stated pressure and temperature range. The buyer is responsible for confirming a component is suitable for the intended application and for installation by a qualified professional.

Limitation of liability

To the maximum extent permitted by law, XMS Heavy Industries is not liable for indirect, incidental, or consequential damages arising from the use of our products. Our total liability is limited to the purchase price of the product. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including a consumer's statutory rights in respect of faulty or non-conforming goods.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts. Where you purchase as a consumer resident in the EU or UK, this does not deprive you of the protection of mandatory consumer law in your country of residence.
